Experimental nature and project limits

1. What this project is

Experimental software developed in person by a single-mandate commercial agent (natural person), for educational, research and technology-outreach purposes, outside of the agency relationship with the agent's principal. This is a social experiment with delegated assumption of responsibility: whoever signs this Notice before download accepts the related risks personally. The Application is not a medical device, is not a civil protection system, is not certified for the safety of human life and does not replace professional tele-assistance, official monitoring or institutional alerting channels (112/118, Civil Protection, INGV).

Identity and contact of the Holder via Q-code. No explicit data (name, address, phone, certified email) is published. GDPR and legal requests go through the channel pointed to by the Q-code.

2. Fall detection (man-down)

The on-device algorithm relies on accelerometer heuristics subject to false positives (e.g. phone thrown on a bed) and false negatives (e.g. slow slide below the variance threshold). In the demonstration version, no real rescue notification is sent to third parties: detection is a visualization of how it works, not an alert system.

Exclusive intended use: educational and outreach. Not for diagnosis, prevention, monitoring or treatment of any medical condition (not covered by MDR EU Reg. 2017/745). Not a safety component under the AI Act (EU Reg. 2024/1689, Annexes II-III). It is forbidden to install this software on behalf of vulnerable persons who have not personally signed this Notice.

3. Seismic alerting

The consensus mechanism relies on crowdsourcing of third-party consumer devices, unstable networks and non-dedicated protocols. Network delays, time misalignment or data injection attempts may impair operation. It is neither a seismograph nor an alerting tool.

4. Service "as is"

The software is provided as is, without warranty of operation, of generation, delivery or reception of any alert, and without warranty of continuity or absence of errors.

5. Limitation of liability and assumption of risk

Within the maximum limits permitted by law, the Developer limits its liability for damages arising from the use or malfunction of the software and from reliance placed on the Application. No insurance coverage has been taken out for the benefit of Users. By ticking the box below, the Signatory declares that they personally assume the risks of the experiment, except for cases of wilful misconduct or gross negligence by the Developer and subject to non-waivable consumer protections. The principal is unrelated to the project and bears no liability.

6. User obligations and responsibility

You understand that the app is an experiment, that you must not use it as a protection measure, and that the safety of a vulnerable person requires professional solutions. Permissions, battery, connectivity and data correctness are your responsibility.

7. Personal data (GDPR)

Raw accelerometer data remains on the device; only aggregated and minimized alerts are stored on the server. Processing pursuant to EU Regulation 2016/679; full details on purposes, legal basis, retention, rights and Holder contact in the Privacy Notice.

8. Full Terms of Use

Acceptance of this Notice also constitutes acceptance of the Terms of Use and conditions of service in their full version, including the clauses on "as is", limitation of liability, indemnification, suspension, modifications and competent court (Italian Civil Code articles 1341-1342).

9. Governing law
